From February 2022 care worker roles will be added to the Shortage of Occupation List. Asylum seekers that have waited longer than 12 months for an initial asylum decision “through no fault of their own” can apply for permission to work with the Home Office.

If granted permission to work applicants can only apply for roles under the Shortage of Occupation List- which now includes care workers. Permission to work expires once a final decision has been made on the asylum claim and there is no further opportunity to appeal.

Working under these rules will not impact an asylum claim.
